This policy is designed with an aim to inform you about the information that Diamonds Factory collects, the reasons why such data is collected and how this data is used to

safeguard your rights when you use our website (www.diamondsfactory.eu) the "Website"), to place orders, or interact with our services. It supplements our Terms & Conditions and complies with the Swiss Federal Act on Data Protection (FADP) of 25 September 2020, the Ordinance to the FADP (DPO), and other applicable Swiss laws.

Note: In the entire policy, "We, Us, Our" refers to "Diamonds Factory” wherein "You, Yours” refers to Customers and Readers.

DEFINITIONS

"Company" means Neve Jewels CH GmbH, a company registered in Switzerland (Company Number CHE- 302 163519), trading as Diamonds Factory, with head office at Nectar Trehuand,

AG Rigistrasse, 3 6300 ZUG and VAT registration number CHE-302.163.519 which is a subsidiary of Neve Jewels Limited (UK, Company Number 694800).

"Group Companies" means Neve Jewels Ltd, its fellow subsidiaries and any other related entities as defined under Article 959 of the Swiss Code of Obligations (CO)."

"Website" means www.diamondsfactory.eu and its associated pages and content.

"Website Content" means any information, text, images, photos, design, files, software, music, sound, and video available on the Website.

1. WHO WE ARE (DATA CONTROLLER):

   Neve Jewels CH GmbH, a company registered in Switzerland (Company Number CHE- 302 163519), trading as Diamonds Factory, with head office at Nectar Trehuand,AG Rigistrasse, 3 6300 ZUG. We are the controller of your data.

   We have appointed a Data Protection Officer (DPO) to oversee compliance with this policy, GDPR, and the Data Protection Act 2018. In case of queries, you can contact our DPO at data.controller@nevejewels.com . The policy is available in English upon request.

2. WHAT WE COLLECT:

   Personal information is only required at the time of purchasing an item, when ordering a ring sizer or when you sign up for the newsletter. Personal information includes, but is not limited to: first name, last name, home address, billing or physical address; email address; phone number & other contact information.

   We may also collect the following information:

   • Demographic information such as postal code, preferences and interests (optional, used for improving services and targeted offers; if not provided, you may miss personalized recommendations).
   • IP addresses (automatically collected for security and analytics; no direct consequence if blocked, but may limit site functionality).

   Other information relevant to customer preferences, surveys and/or offers (optional; non-provision means exclusion from surveys/offers).

   Collection is voluntary unless specified as mandatory, and we will inform you of any consequences if you choose not to provide it (e.g., inability to complete a transaction). This aligns with FADP Art. 6 (proportionality, purpose limitation).

   We do not collect sensitive personal information (e.g., health data) unless directly relevant and with your explicit consent (FADP Art. 30).

   We minimize collection to what's necessary as defined under FADP Art. 6(2). We state that we do to collect children's data (under 16) without parental consent FADP Art. 31 and the Swiss Civil Code (ZGB Art. 19).

3. WHY WE COLLECT THIS INFORMATION:

   We are 100% committed to protecting your privacy and security and we totally appreciate and respect how important privacy is. We will strive to ensure that your data is not used for any other than aforementioned by us or by the third parties engaged by us.

   This personal data will only be used for the specific purpose it was collected for.

   We require this information after you’ve shared your legitimate consent as per provisions of Article 6 of the FADP, to understand your needs and provide you with a better service, for the following reasons:

   • To process the order and deliver products in a timely manner.
   • To send confirmation and updates on your order.
   • Internal recording (e.g., order history; retained for up to 10 years as required by commercial laws, or until no longer needed).
   • We may use the information to improve our website, products and services (e.g., analyzing preferences; data anonymized where possible).
   • We may periodically send promotional emails about new products, special offers, or other information we think you may find interesting using the email address you have provided (only with your explicit consent under the Unfair Competition Act (UCA) Art. 3; you can withdraw consent at any time).

   Note: Marketing requires your explicit opt-in (e.g., via checkbox during signup). We use double opt-in for email/SMS lists to confirm consent. If at any time you no longer wish to receive communications from us, you may opt out or email us at service@diamondsfactory.eu. Opt-outs are processed immediately, and we maintain consent records. We comply with UCA for anti-spam in electronic marketing.

   • When you visit our website, Diamonds Factory collects your IP address to, among other things, diagnose problems with its server, administer and tune the operation of its website, analyze trends, track traffic patterns, gather demographic information for aggregate usage, and track the date and duration of each session on our website. Your IP address may also be used in conjunction with your personal information for credit fraud protection and risk mitigation (retained only as long as necessary for these purposes, typically up to 2 years).

   • We comply with the Unfair Competition Act (UCA) to ensure fair marketing practices.

To prevent unauthorized access or disclosure, we have implemented suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect online, in accordance with FADP Art. 8 (security measures appropriate to risk).

   In the event of a data breach posing a high risk to your rights, we will notify the Federal Data Protection and Information Commissioner (FDPIC) and affected individuals promptly, as per FADP Art. 24.

5. COMPLIANCE WITH LAWS AND FRAUD PREVENTION:

   We may collect and disclose any information, including personal information, that we, in our sole discretion, believe necessary to comply with applicable law, regulation, legal process, or governmental request. We may collect and potentially disclose personal information and other information at our disposal to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law. We may also share information, including personal information, with other companies and organizations for credit fraud protection and risk mitigation.

   All disclosures are limited to what is necessary, with consent where required under FADP Art. 6.

6. INFORMATION FOR THIRD PARTIES:

   Third parties may use your personal information. For example, when we ship the product to you, we will need to share your full name and shipping address with our delivery agent. Examples of other third parties with whom we may share your personal information include: web hosting companies, fulfillment companies (e.g., companies that fulfill product orders), our group companies, its fellow subsidiaries (within Switzerland, the EU/EEA, and non-adequate third countries, with appropriate safeguards such as Swiss-recognized Standard Contractual Clauses or adequacy decisions), jewelers, assemblers, data analytics companies, affiliates, third-party consulting or marketing firms, and email service providers.

   If you order a credit card or other financing alternative from Diamonds Factory, in order to confirm and process your order, we will share your personal information with that financing company.

   These third parties will only receive personal information if that information is needed to perform their function(s) and they are not authorized to use personal information for any purpose other than those specified by Diamonds Factory.

   We will only provide third parties with the minimum amount of personal information necessary to complete the requested service, product, and/or transactions and are bound by agreement ensuring FADP compliance.

   We conduct vendor due diligence and audits. Non-essential sharing requires your explicit consent.

7. YOUR RIGHTS:

   Under FADP, you can:

   Right to Information (Article 25) – You can request details on whether their data is being processed, including our identity, processing purpose, data categories, retention period, data sources, recipients, and transfer safeguards. We handle the requests within 30 days, free of charge (unless disproportionately burdensome). We may allow verbal requests exceptionally.

   Right of Access (Article 25(2)) – You can request the actual personal data being processed. We will provide a copy if requested; and it applies to authorized representatives too.

   Right to Data Portability (Article 28) – You can receive their data in a structured, machine-readable format (e.g., CSV/JSON) and transfer it to another controller. Such transfers apply only to automated processing based on consent or contract.

   Right to Rectification (Article 32) – You can demand correction of inaccurate or incomplete data. We will comply with the request unless it is prohibited by law (e.g., archiving) or unverifiable. We will flag disputed data. We will also notify recipients (e.g., third parties) of changes.

   Right to Erasure ("Right to be Forgotten") (Article 32) – You can request deletion of data if it's no longer needed, or you withdraw your consent, or if we are unlawfully processing your personal data, or if you have any other objection. We will notify recipients (e.g., third parties) of changes.

   Right to Object (Opt-out) (Article 30(2)(b)) – You can object to processing based on legitimate interests, public tasks, or direct marketing at any time. We will stop these marketing or promotional campaigns, unless compelling reasons override (e.g., legal claims).

   Right to Withdraw Consent (Implied in Art. 6 – consent as basis) – Your consent-based processing can be withdrawn at any time, prospectively. We inform of this right upfront.

   Right Not to be Subject to Automated Individual Decision-Making (Article 21- Transparency in Decisions) – You can object to decisions based solely on automated processing (e.g., AI scoring) with legal effects (e.g., credit denial). We must allow human intervention if objected. can express their view, request human review, and challenge the decision. It does not prohibit such processing but ensures transparency.

   Right to Lodge a Complaint (Article 58) – You can file complaints with the FDPIC for alleged FADP breaches. The FDPIC investigates and mediates; without levying direct fines, but has the authority to refer such complaints to the relevant courts. The process is free and accessible.

   You can also send an appeal to FDPIC in case of no response from us for a month.

8. EMAIL THIS PRODUCT TO A FRIEND:

   If you email a product to a friend, you and your friends' names and email addresses will be requested. This ensures your friend knows you've received an email from Diamonds Factory. You and your friends' email addresses will be used for this purpose only, unless permission is granted otherwise.

9. MOBILE MESSAGING SERVICE PRIVACY POLICY:

   • We value your privacy and the information you provide to us in connection with our SMS marketing service. We use this information to send you SMS notifications (for your order, including abandoned cart reminders), SMS marketing offers, and transactional texts, including requests for reviews from us. Opt-in data and text messaging consent are not shared with third parties, except with messaging partners hired by us or the parent company, to enable and operate our text messaging program.
   • Text messaging opt-in data and consents will not be shared with third parties, except with messaging partners to enable and operate our text messaging program.
   • Our website uses cookies to track which items you have added to your shopping cart, even if you abandon the process. This information is used to determine when to send a shopping cart reminder SMS.
   • Explicit consent is required under UCA Art. 3, with easy opt-out. Opt-out by replying "STOP". We maintain consent records.

10. BUSINESS TRANSFER:

    Your personally identifiable information may be disclosed as part of a merger, sale of company assets, or acquisition, as well as in the event of insolvency, bankruptcy, or receivership in which personal information is transferred as one of the business assets of the company. In such cases, we ensure continued protection or notify you for new consent, per FADP Art. 6.

11. INTERNATIONAL TRANSFERS:

    Information collected on this website may be stored and processed in the United Kingdom or any other country in which Diamonds Factory or its affiliates, its fellow subsidiaries or agents maintain facilities, and you consent to this transfer of information outside your country.

    We ensure adequate protection under FADP Art. 16-18 (to adequate countries or with safeguards like contracts). Your consent is obtained (e.g., via checkbox), with disclosure of destinations and risks.

13. HOW WE USE COOKIES:
